Congress Passed the Nuclear Energy ADVANCE Act: What You Should Know

Last week, Congress officially passed the ADVANCE Act after the bill successfully navigated its way through the Senate. 

I’ll admit it was a rare thing to witness watching both sides of the aisle come together, especially during a heated election year. 

And I’m not talking about some pass-by-the-skin-of-your-teeth type of passage, either. The ADVANCE Act flew threw the Senate by a vote of 88 to 2; the bill enjoyed wide bipartisan in the House as well after it was passed 393 to 13. 

Forgotten was the bickering and vitriolic division between the two parties that have a bad habit of only passing pork-laden legislation. For once, our politicians may have gotten things right.

“So why should I care about this?” you ask.

Well, that’s easy. Of all the virtue signaling promises of a greener future, the U.S. is finally pushing forward with a a true “all-of-the-above” energy strategy that will develop next-gen nuclear technology. 

And it’s about time, too.

The ADVANCE Act: What You Should Know

Let’s take a second and actually look at what this bill accomplishes, shall we? 

The Accelerating Deployment of Versatile, Advanced Nuclear for Clean Energy Act — or ADVANCE Act, for short (people do love their acronyms, don’t they) — does several things. For those of you interested, you can actually read the full text here.

Here’s a quick summary:

This bill sets forth provisions to develop and deploy advanced nuclear fuel for the United States and certain allied countries, restrict the possession or ownership of enriched uranium from Russia or China, clean up hazardous land, and establish related requirements.

Specifically, the bill provides incentives for developing and deploying new nuclear technologies, such as reduced licensing fees and prize awards for deploying such technologies. It also extends through 2045 the indemnification policy under the Price-Anderson Act that limits liability related to the nuclear industry.

It also requires the Nuclear Regulatory Commission (NRC) to (1) develop a process that enables timely licensing of nuclear production facilities or utilization facilities at brownfield sites, and (2) establish an initiative to enhance preparedness and coordination with respect to the qualification and licensing of advanced nuclear fuel. NRC may hire specialized staff without regard to civil service laws to address its critical licensing or regulatory oversight needs.

The NRC must also coordinate certain international nuclear activities and may establish an International Nuclear Reactor Export and Innovation Branch within the Office of International Programs. The bill allows certain foreign entities to receive licenses under the Atomic Energy Act of 1954 for nuclear utilization facilities as specified by the bill.

The bill also allows the Environmental Protection Agency to conduct activities to assist in cleaning up certain abandoned mining sites on tribal lands that are hazardous.”

Essentially, it facilitates the development and deployment of next generation nuclear energy technology. 

However, there’s something in the ADVANCE Act that is particularly special for our investment community here at Energy & Capital.

I’ll give you a hint… it’s been something we’ve been waiting a long time for, and Congress just opened a huge window of opportunity for any investor smart enough to take the time to see it.

Turning the ADVANCE Act Into Pure Profit

Last week, I told you that the real money won’t be in building the multi-billion dollar next-gen nuclear plants, which are notorious for delays and running over budget. 

Truth is, the real money will be in FUELING them.

And one thing that the ADVANCE Act does is expedite the NRC licensing process for advanced nuclear fuel technologies, as well as enable the testing and demonstration of accident tolerant fuels for existing commercial nuclear reactors. 

We’re talking about more than just traditional reactors. 

Look, it wasn’t a coincidence that the day before the ADVANCE Act was passed in the Senate, the Department of Energy announced it would spend $900 million supporting the initial U.S. deployment of Generation III+ small modular reactors. 

Although it received little attention in media headlines, the ADVANCE Act was a landmark piece of legislation for the U.S. nuclear industry. This also has put us on a path of developing the kind of reliable baseload power that our grid is craving right now.
